Lawyer Lim Seng Siew of Ong Tay and Partners told The New Paper that bloggers who post defamatory statements can be sued by the person defamed. It does not matter where the blogger or server is located.

He said: 'In the Odex situation, if the words and the pictures are crafted in a way that is harmful to that person's reputation, then there is defamation.

'The bloggers can avoid liability only if they can show that their statements are true or justifiable.'


We wouldn't want anyone from here to get into this kind of trouble cause it is not worth it at all.

this one I'm well very versed... haha if I got a buck for every foul mouth and threat, me millionaire liao...

than those who work in collections would be billionaires.

and loan sharks would be the richest ppl in this country.

even with voice recordings and video tapes, the amount awarded, if any is usually insignificant to cover the cost of legal proceedings. Only "u-know-who" defamation cases than got big bucks.

If not, your party has to prove that the COST of the defamation. Which if u are a nobody is extremely difficult to estimate.

darn even in assault cases with full frontal videos, the awarded amount in these civil suits aren't like the states.

anyway, i personally feel that netizens should just stop posting threats. This type of actions will only lead to lawsuits. If they are unhappy with how ODEX is handling the situation, just don't do anything and don't buy their stuffs and import better quality VCDs/DVDs.

I believe posting on how they are not going to buy any VCDs/DVDs licenced by ODEX is fine. And ways to import better quality VCDs/DVDs are a way of handling the situation without any legal action being taken against anyone.

this I can understand... they hired lawyers already for a job, there is nothing wrong in asking em about XYZ and ABC. I do that myself. How u use the "free" legal advice is up to you. Besides not all lawyers are correct, and not all lawyers say the same thing.

1 - If wanna gather 5000 ppl, make sure you get permit from Police first.

2 - If you dun want to get permit, make sure you gather in groups of less than 5 ppl. If not, you can be charged for illegal gathering.

oh.. and don't make placards.

waste of wood and paper cos there's no way u can use it after the event. Save Gaia.

I think would be good for all to make T-shirts with printings to express the group feelings towards the situation. But must be phrased in a way that's not defamatory.

After the event, the T-shirts still can be worn.

Protesting probably won't help the victims much.

The best way to "fight" Odex, if the victims really want to, is in court.

While I'm no lawyer, I'm just thinking -

1. I understand that Odex sent out letters to many people (around 1000?) saying "Pay up or see you in court" without prior "Cease and Desist" warning letters.

2. What happens if person A doesn't want to pay, and person B also doesn't want to pay? Does Odex sue A and B separately?

3. If point 2 above is correct, then Odex will be spending lotta cash suing people individually especially if say... 300 out of the 1000 doesn't want to pay....

4. If Odex sues the 300 people collectively under 1 case, to save cash, the 300 people can band together and fight this case in court. 300 people should provide adequate resources (financial and otherwise) for legal defense.

Just something for you guys to think about..... *Grin*
