Personally I'm not sure if the fact that the Sub Court has turned down Odex's application against PacNet for disclosure of the personal particulars of its subscribers will have any impact on the former's claims against the parties whom it already has obtained information on.

At this juncture, it would seem that the Court is not determining the merits of Odex's claim, but merely whether it is entitled to the information it is seeking. Therefore even if it may be argued that the information had been improperly obtained, Odex may still be able to prove infringement of copyright.

However, as you have highlighted, the question does remain whether the claimant is entitled to the sum that they are claiming. For starters, it may help if you have a list of the persons who have received the demand letters and see if they're prepared to collectively get a lawyer to represent them.

If the parties are minors, then they will need the approval of their parents/guardians.

so do hold on first. This will take a while.

On the settlement side, 2 issue have been highlighted to Odex on my side.

1. The settlement amount is just too much.
2. The letter of undertaking..... Com'on we all think it was ok to download anime. and to what extend is it illegal we need Judge Lau to update us.

i believe everyone has the same starting point of trying to help ppl, be it a all out against with o--x or a more calm and peaceful resolution.

But at this point, the whole event has just reached another high point, and wat might the future holds is still unclear, so lets just cooperate with whoever is trying to help.
