Shld i be firm on the warranty issue with nakhire? altya1 Sep 16th, 09, 02:51 AM #1 (permalink)
I tink most people here noes that nakhire is selling ear piece here in Vr zone and recently is starting to sell again...

i personally has bought from him last year a CX 300 and was assured a 2 year warranty but recently it had problems and i need a replacement set.

I pmed nakhire and he told me he don have any sets anymore so he cant honor his warranty but offer me to top up more money to get his newer models.

I decided for a while but went overseas so don have time to deal with him yet but now that i am back, just curious whether shld i really persist on for my deserved replacement set?

When you guys deal, was it agreed that warranty was subject to availability of stock, or was it mutually understood - don't need to say it out.

If seller say - warranty subject to availability of stock then it's no replacement or subject to seller decision.

If seller say - warranty 2 years and no more then buyer have absolute right to purse his replacement. Since seller never list the TOC then he should replace the spoilt item with another similar item or one of equal value or higher, NOT ask buyer to top up.

That's how RMA mostly work outside, correct?

Personally, I think if you buy anything with warranty outside, within the warranty period, the seller is expected to give you a replacement. And usually if the product is end of life already or not more stock, they will replace with a newer or more expensive model.

You should check senn's warranty policy first:
Sennheiser Worldwide: Microphones, Headphones and Wireless Systems

Usually, unless product EOL, the distro just need to accept the faulty product and ship it back to manufacturor. Or shop just need to ship back to distro. So neither shop or distro bare the cost of the problems by manufacturor.

We have a distro of senn products right here in SG - Sennheiser themself

But all these only applies if the product is not counterfeited though.

what TS had said in post 1 seem more like a "private deal" than a distro - manufacturor warranty.

If he had the official warranty then go straight to the distro, why bother with the seller again.

I guess the "lack of offician warranty" part and associated risks when buying these kind of stuff is well-known.

Then that's no need to press further. This shall work out on a case-by-case basis. TS should just go for it, but if results are not as hoped what can be done? Since there is no black or white or anything.

To me TS should go for it.
2yrs warranty subject to availability? I don't think nakshire stated this in his thread.
Then what for give 2yr warranty then EOSL in 5 days time if suppose 5 days later he sold all? LOL....its a joke sia.

yup, when i bought from him, he didnt state anything abt subject to availaility tot..... he just promise me that IF anything went wrong, i just have to contact him and send him back the spoilt set and he will replace one for me...

after quite many occasion of people doubting him regarding his product, he still assure me that his warranty is still valid....

but when now it finally spoilt, i pm him and he just give me a reply saying that no stock available so he cant give me a replacement set. And if i really want one, i have to top up for a better model which i tink is abit weird coz i deserved a replacement set in the set place regardless of whether its the same set or a better set

Hmm, lucky I went straight to FutureSonics Atrios instead of getting a PL50 from him. At least FutureSonics is assured of excellent service.

one should stick to the original sales terms unless both parties are agreeable with the proposed amendments.

yup yup, as long as there are stocks, of course will change.

But then seriously speaking, i stopped sales means i not taking in goods liao. Altya, if u can see my thread, there's no more cx-300. Its seriously sold out... bo liao..

A warranty link is in my blog too, dated Jan 09.

If u ask anyone in the forums see who managed to change, i bet there are quite a few there who really did had a 1-1 exchange. I din say dun have wor...

As what CyberTron said, i can also offer u the other models for replacement, provided that u can top up for the remaining cost incurred. Thats the best solution i can give u for the current situation.

I think there's no need for a thread like this too. We can settle this personally.

As a goodwill gesture, you should replace it with a same, similar or same price item or even a newer or more expensive model.

That's how warranty mostly work outside.

You should not treat it as a opportunity to earn a few more bucks or maybe I am wrong.

If you made a loss by giving TS a more expensive model. Then you have to accept it because you initially promised full warranty with no specific terms.

i tink u misunderstood, CyberTron was saying that u replace me with a newer and better one WITHOUT topping up as u have to honor the replacement warranty...

btw u did specific ur clause in ur blog but i bought it way b4 when u post it...
