SAN FRANCISCO -(Dow Jones)- Psystar Corp., a maker of clone computers that run Apple Inc.'s (AAPL) popular operating system, has been barred by a federal judge from making products based on the consumer electronics giant's software. On Tuesday, U.S. District Judge William Alsup issued a permanent injunction against Doral, Fla.-based Psystar that prohibits it from copying, selling or creating derivative works based on Apple's Mac OS X. Stating that Apple had provided significant evidence that Psystar's products infringed Apple's intellectual property, Alsup wrote that an "injunction is both equitable and reasonable to prevent or restrain further infringement of Apple's copyrights." Psystar has until Dec. 31 to comply with the new ground rules. The decision is the latest twist in a year-and-a-half-long dispute between Psystar and Cupertino, Calif.-based Apple. Apple initially sued Psystar in July 2008, about four months after Psystar began selling machines that came with Apple's operating system installed on them. Since then, Psystar has filed for Chapter 11 bankruptcy protection. An Apple spokesman declined to comment. A Psystar attorney did not return calls or emails seeking comment. Alsup's order comes about two weeks after he found Psystar liable for violating Apple's copyrights. Apple and Psystar then reached a partial settlement in which Psystar agreed to pay Apple $1.3 million in damages. Over the last few weeks, Psystar's Web site has stated that it doesn't have three models it makes that come with the Apple software. |
